{"id":8695,"date":"2021-09-23T12:05:39","date_gmt":"2021-09-23T10:05:39","guid":{"rendered":"https:\/\/www.pymelegal.es\/?p=8695"},"modified":"2021-09-23T12:05:39","modified_gmt":"2021-09-23T10:05:39","slug":"proteccio-de-dades-en-els-processos-de-seleccio","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/proteccio-de-dades-en-els-processos-de-seleccio","title":{"rendered":"Protecci\u00f3 de dades en els processos de selecci\u00f3"},"content":{"rendered":"<blockquote><p>L\u2019<strong>RGPD<\/strong> defineix les <strong>dades personals<\/strong> com: <strong><em>\u201ctota informaci\u00f3 sobre una persona f\u00edsica identificada o identificable<\/em><\/strong><em> (\u2026)\u201d<\/em> i <strong>tractament<\/strong> com: <em>\u201c<strong>qualsevol operaci\u00f3 o conjunt d\u2019operacions realitzades sobre dades personals<\/strong> o conjunts de dades personals, ja sigui per procediments automatitzats o no, com la recollida, registre, organitzaci\u00f3, estructuraci\u00f3, conservaci\u00f3 (\u2026)\u201d<\/em>. Seguint amb aquestes pautes <strong>l\u2019entrega d\u2019un CV<\/strong> en format f\u00edsic o electr\u00f2nic <strong>suposa un tractament de dades<\/strong> sotm\u00e8s a la normativa de protecci\u00f3 de dades.<\/p><\/blockquote>\n<p>A continuaci\u00f3, abordarem tres de les q\u00fcestions m\u00e9s rellevants en relaci\u00f3 amb el procediment de recepci\u00f3 de CV.<\/p>\n<h2><strong>\u00c9s necessari el consentiment de la persona durant el proc\u00e9s de selecci\u00f3 per a realitzar el tractament de les dades?<\/strong><\/h2>\n<p><strong>No<\/strong>, el tractament de dades durant el proc\u00e9s de selecci\u00f3 no exigeix el consentiment de la persona interessada.<\/p>\n<p>L\u2019article 6.1 b) de l\u2019RGPD estableix que <strong>el tractament ser\u00e0 <\/strong><a href=\"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/licitud-del-tractament\" target=\"_blank\" rel=\"noopener\"><strong>l\u00edcit<\/strong><\/a><strong> si \u00e9s necessari per executar un contracte en qu\u00e8 l\u2019interessat<\/strong> (en aquest cas, la persona candidata) <strong>\u00e9s part<\/strong> o per a l\u2019aplicaci\u00f3 de mesures precontractuals sol\u00b7licitades per aquesta part. Tamb\u00e9 hem de tenir en compte el considerant 44 de l\u2019RGPD que espec\u00edfica que: <em>\u201cEl tractament ha de ser l\u00edcit quan sigui necessari en el context d\u2019un contracte o de la intenci\u00f3 de concloure un contracte\u201d.<\/em><\/p>\n<p><strong>En cas de qu\u00e8 les dades incloses en el CV s\u2019utilitzin despr\u00e9s per a altres fins<\/strong>, per exemple, comercials, implicar\u00e0 que <strong>necessitarem una altra base jur\u00eddica<\/strong>, com el <a href=\"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/consentiment-comunicacions-comercials-i-rgpd\" target=\"_blank\" rel=\"noopener\">consentiment<\/a> o l\u2019inter\u00e8s leg\u00edtim.<\/p>\n<h2><strong>Com podem informar a la persona candidata?<\/strong><\/h2>\n<p>El deure d\u2019informaci\u00f3 s\u2019haur\u00e0 de dur a terme per <strong>mitjans que permetin provar el compliment i es conservar\u00e0 mentre duri el tractament.<\/strong><\/p>\n<p>La recepci\u00f3 de CV pot venir per dues vies diferenciades, per un anunci o convocat\u00f2ria on l\u2019empresa en q\u00fcesti\u00f3 indiqui que t\u00e9 una vacant o per l\u2019entrega de la persona candidata del seu CV.<\/p>\n<p>En el primer cas a l\u2019<strong>anunci o convocat\u00f2ria s\u2019haur\u00e0 d\u2019incloure la informaci\u00f3 de l\u2019art. 13<\/strong> de l\u2019RGPD. En el segon sup\u00f2sit <strong>l\u2019empresa haur\u00e0 de fixar un procediment d\u2019informaci\u00f3<\/strong> que permeti confirmar que s\u2019informa al candidat correctament.<\/p>\n<p>En cas de qu\u00e8 el CV s\u2019envi\u00ef per correu electr\u00f2nic o postal es podr\u00e0 enviar la informaci\u00f3 a l\u2019adre\u00e7a del remitent i esperar la confirmaci\u00f3 per iniciar el tractament. En cas de qu\u00e8 s\u2019entregui f\u00edsicament s\u2019haur\u00e0 d\u2019informar all\u00ed per qualsevol mitj\u00e0 que permeti l\u2019acreditaci\u00f3, per exemple, mitjan\u00e7ant cartells.<\/p>\n<h2><strong>Com es pot regular l\u2019enviament de CV? Existeix algun l\u00edmit a la informaci\u00f3 que l\u2019empresa pugui demanar?<\/strong><\/h2>\n<p>Es recomana establir un \u00fanic canal per a l\u2019enviament, de manera que sigui m\u00e9s f\u00e0cil controlar-lo, per exemple, via <strong>formulari tipus on es demani la informaci\u00f3 necess\u00e0ria<\/strong> i en aquest mateix es doni la informaci\u00f3 requerida per la normativa. S\u2019han de respectar els <strong>principis de minimitzaci\u00f3 i limitaci\u00f3<\/strong> i no demanar informaci\u00f3 de manera indiscriminada, sin\u00f3, <strong>\u00fanicament aquelles dades rellevants per al lloc<\/strong>.<\/p>\n<p>Per al cas de qu\u00e8 arribin CV per altres mitjans se\u2019ls pot indicar que ho envi\u00efn pel mitj\u00e0 establert.<\/p>\n<h2><strong>Sancions<\/strong><\/h2>\n<p>Com hem comentat a l\u2019inici de l\u2019article, aquest tractament es troba subjecte a la normativa de protecci\u00f3 de dades i el <strong>seu incompliment pot arribar a sancions<\/strong>.<\/p>\n<p>El passat 23 de juliol de 2021 l\u2019Ag\u00e8ncia va interposar una <a href=\"https:\/\/www.aepd.es\/es\/documento\/ps-00237-2021.pdf\" target=\"_blank\" rel=\"noopener\"><strong>sanci\u00f3 de 2.000 \u20ac<\/strong><\/a> a una empresa per <strong>incomplir amb l\u2019esmentat art. 13 de l\u2019RGPD<\/strong>, al no proporcionar al candidat la informaci\u00f3 relativa al tractament de les seves dades ni la possibilitat d\u2019exercitar els seus drets davant el responsable del tractament.<\/p>\n<p>Us seguirem informant, i si necessiteu m\u00e9s refer\u00e8ncies, no dubteu en contactar amb nosaltres, estem a la vostra disposici\u00f3!<\/p>\n<p>L\u2019Equip de PymeLegal<\/p>\n","protected":false},"excerpt":{"rendered":"<p>L\u2019RGPD defineix les dades personals com: \u201ctota informaci\u00f3 sobre una persona f\u00edsica identificada o identificable (\u2026)\u201d i tractament com: \u201cqualsevol operaci\u00f3 o conjunt d\u2019operacions realitzades sobre dades personals o conjunts de dades personals, ja sigui per procediments automatitzats o no, com la recollida, registre, organitzaci\u00f3, estructuraci\u00f3, conservaci\u00f3 (\u2026)\u201d.
