{"id":7509,"date":"2021-04-21T16:15:24","date_gmt":"2021-04-21T14:15:24","guid":{"rendered":"http:\/\/davidp166.sg-host.com\/noticias\/sense-categoria\/obligacio-registre-salarial"},"modified":"2021-05-06T09:09:46","modified_gmt":"2021-05-06T07:09:46","slug":"obligacio-registre-salarial","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/normatives\/obligacio-registre-salarial","title":{"rendered":"Obligaci\u00f3 Registre Salarial"},"content":{"rendered":"\n<blockquote class=\"wp-block-quote justificar is-layout-flow wp-block-quote-is-layout-flow\"><p>El 14 d\u2019abril ha entrat en vigor el Reial Decret 902\/2020, de 13 d\u2019octubre, d\u2019igualtat retributiva entre homes i dones, on s\u2019estableixen un conjunt de mesures per a fer efectiu el dret a la igualtat de tracte i no discriminaci\u00f3 entre dones i homes quant a la retribuci\u00f3 salarial es refereix.<\/p><\/blockquote>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Entre aquestes mesures es troben <strong>l\u2019obligaci\u00f3 d\u2019elaborar un registre retributiu salarial<\/strong> i implementar-lo a partir del <strong>14 d\u2019abril<\/strong> d\u2019aquest any. &nbsp;Aix\u00f2 \u00e9s conseq\u00fc\u00e8ncia de l\u2019establert a l\u2019article 28.2 de l\u2019Estatut dels Treballadors, el qual estableix l\u2019obligaci\u00f3 de disposar de registre salarial.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Per\u00f2, <strong>qu\u00e8 \u00e9s un registre salarial?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Un <strong>registre salarial<\/strong>, segons l\u2019Estatut dels Treballadors, \u00e9s un registre on es recullen els valors mitjans dels salaris, els complements salarials i les percepcions extrasalarials de la plantilla, desagregats per sexe i distribu\u00efts per grups professionals, categories professionals o llocs de treball iguals o d\u2019igual valor. D\u2019aquesta manera es pret\u00e9n garantir la <strong>transpar\u00e8ncia<\/strong> en les retribucions i igualar la<strong> retribuci\u00f3 pel mateix treball i amb igual valor<\/strong> i facilitar l\u2019acc\u00e9s a la informaci\u00f3, independentment del n\u00famero de treballadors de l\u2019empresa.<\/p>\n\n\n\n<p class=\"justificar wp-block-paragraph\">A m\u00e9s, haur\u00e0 d\u2019incloure el c\u00e0lcul anual de la mitjana aritm\u00e8tica i la mitjana del realment rebut per cadascun dels conceptes indicats, presumint que, en cas de qu\u00e8 la mitjana resultant sigui superior, en almenys un 25 % d\u2019un sexe respecte al altre, existir\u00e0 <strong>bretxa salarial<\/strong>, i, per tant, infracci\u00f3 sancionable.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quines empreses han de comptar amb aquests registres?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\"><strong>Totes les empreses<\/strong> han de disposar d\u2019aquest tipus de registres, independentment de la seva mida, a difer\u00e8ncia del que succeeix amb el <strong>Pla d\u2019Igualtat<\/strong>, que nom\u00e9s estan obligades a tenir-lo les empreses amb m\u00e9s de 50 treballadors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qu\u00e8 s\u2019ha d\u2019incloure en el registre salarial?<\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">El registre haur\u00e0 d\u2019incloure els valors mitjans de salaris, complements salarials i percepcions extrasalarials de la manera en qu\u00e8 ho indica l\u2019Estatut dels Treballadors, \u00e9s a dir, per sexes. Tamb\u00e9 hauran d\u2019incloure les mitjanes aritm\u00e8tiques i la mitjana del que realment s\u2019ha percebut per cadascun d\u2019aquests conceptes: grup professional, categoria, nivell, lloc o qualsevol altre sistema de classificaci\u00f3 aplicable.<\/p>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Hauran d\u2019incloure\u2019s <strong>tots els membres de la plantilla<\/strong>, inclosos el personal directiu i els alts c\u00e0rrecs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Qui podr\u00e0 accedir al registre salarial?<\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\"><strong>No tothom podr\u00e0 tenir acc\u00e9s a aquests registres<\/strong>. A les empreses amb <a aria-label=\"undefined (abre en una nueva pesta\u00f1a)\" href=\"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/drets-digitals-ii-ambit-laboral\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>representaci\u00f3 legal dels treballadors<\/strong><\/a>, el treballador no podr\u00e0 accedir directament a aquests registres, sin\u00f3 que haur\u00e0 de sol\u00b7licitar-ho a aquests representants dels treballadors. A les empreses en les que no existeixi aquesta representaci\u00f3 legal dels treballadors, nom\u00e9s es donar\u00e0 acc\u00e9s a les dades anonimitzades respecte les difer\u00e8ncies de percentatges i l&#8217;empresa decidir\u00e0 quines proporciona i de quina forma. Cal tenir present que l&#8217;<strong>objectiu del registre no es saber qui cobra m\u00e9s o menys respecte un altre empleat, sin\u00f3 si existeix una desigualtat de salaris entre homes i dones.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Cada quan s\u2019ha d\u2019actualitzar el registre?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">El registre s\u2019haur\u00e0 d\u2019actualitzar cada any, concretament, la refer\u00e8ncia \u00e9s l\u2019<strong>any natural<\/strong>, sense perjudici de les modificacions que l\u2019empresa estimi oportunes en cas de produir-se una alteraci\u00f3 substancial de qualsevol dels elements que integren el registre.<\/p>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Quan es vulgui crear o modificar el registre, en cas d\u2019existir representaci\u00f3 dels treballadors, se\u2019ls haur\u00e0 de <strong>consultar <\/strong>amb un m\u00ednim de <strong>10 dies d\u2019antelaci\u00f3<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Poden sancionar a l\u2019empresa per no disposar de registre salarial?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">S\u00ed, el fet de no disposar de registre salarial pot ser <strong>constitutiu d\u2019inici d\u2019accions administratives i judicials, aix\u00ed com l\u2019aplicaci\u00f3 de sancions per discriminaci\u00f3<\/strong>, segons ho estableix l\u2019art. 10 del RD 902\/2020. Aix\u00ed mateix, i atenent a la gravetat dels fets (no tenir aquest registre o falsejar-lo, per exemple), haurem d\u2019acudir al disposat a la <strong>Llei d\u2019Infraccions i Sancions de l\u2019Ordre Social<\/strong> (LISOS), la qual estableix que:<\/p>\n\n\n\n<ul class=\"justificar wp-block-list\"><li>Per a les infraccions que es cataloguin com a <strong>greus<\/strong>, la sanci\u00f3 oscil\u00b7lar\u00e0 entre els <strong>626<\/strong> i els <strong>6.250 \u20ac.<\/strong><\/li><li>Per a les infraccions que es cataloguin com a <strong>molt greus<\/strong>, la sanci\u00f3 oscil\u00b7lar\u00e0 entre els <strong>6.251<\/strong> i els <strong>187.515 \u20ac.<\/strong><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>I, com ha de ser aquest registre?<\/strong><strong><\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">En aquests moments es desconeix el format que l\u2019Administraci\u00f3 vol que tingui aquest registre, tanmateix, i segons indica el diari \u201c<strong>Cinco d\u00edas<\/strong>\u201d, \u201cel Gobierno ha creat una eina que ser\u00e0 volunt\u00e0ria i gratu\u00efta, segons han confirmat a EFE fonts del Ministerio de Trabajo. Aquesta eina, consensuada entre els Ministeris de Treball i Igualtat i els agents socials, permetr\u00e0 fer \u00absenzilla, intel\u00b7ligible i intu\u00eftiva\u00bb l\u2019elaboraci\u00f3 d\u2019aquests registres salarials\u201d.<\/p>\n\n\n\n<p class=\"justificar wp-block-paragraph\">En conclusi\u00f3, a partir del 14 d\u2019abril tota empresa ha de disposar d\u2019un registre de salaris, com a mesura dirigida a tancar la bretxa salarial entre homes i dones que ronda el 22 % actualment a Espanya.
