Doncs b\u00e9, el 23 de setembre s\u2019ha publicat al BOE l\u2019aprovaci\u00f3, pel Consell de Ministres, del <a aria-label=\"undefined (abre en una nueva pesta\u00f1a)\" href=\"https:\/\/www.boe.es\/boe\/dias\/2020\/09\/23\/pdfs\/BOE-A-2020-11043.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Reial Decret-Llei, 28\/2020, de treball a dist\u00e0ncia<\/strong><\/a><strong>.<\/strong><\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Us resumim el seu contingut i l\u2019escenari en el que podr\u00e0 desenvolupar-se el teletreball.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>A quins treballadors aplicar\u00e0 aquesta Llei?<\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">S\u2019aplicar\u00e0 a aquells treballadors que treballin a dist\u00e0ncia amb car\u00e0cter \u201cregular\u201d. El terme \u201cregular\u201d es tradueix en treballar en aquesta modalitat el 30 % de la jornada en remot en un per\u00edode de refer\u00e8ncia de tres mesos. Hi haur\u00e0 excepcions en les que es calcular\u00e0 el percentatge proporcional equivalent en funci\u00f3 de la durada del contracte de treball.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La llei no ser\u00e0 d\u2019aplicaci\u00f3 al personal laboral al servei de les Administracions P\u00fabliques, que es regir\u00e0 per la seva normativa espec\u00edfica.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quan entri en vigor, <strong>com s\u2019aplicar\u00e0, qu\u00e8 hem de signar i quant temps hi ha per adaptar-se?<\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Tal i com s\u2019indica en el propi RDL, en la Disposici\u00f3 Final Catorzena, entrar\u00e0 en vigor als 20 dies de la seva publicaci\u00f3 al BOE. Aix\u00f2 vol dir que, aquelles <strong>empreses que ja tenien acords col\u00b7lectius sobre teletreball<\/strong> <strong>tindran un any per adaptar-se<\/strong> a la nova normativa. Per a <strong>la resta, el termini \u00e9s de fins a tres anys<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>I quines obligacions comporta aquesta normativa respecte al teletreball?<\/strong><\/h2>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Les empreses que apliquin aquesta modalitat de treball hauran de <strong>formalitzar un acord per escrit<\/strong> definint una s\u00e8rie de continguts m\u00ednims. Podr\u00e0 formar part del contracte inicial o realitzar-se en un moment posterior, sense que aquesta modalitat pugui ser imposada. <strong>Requerir\u00e0 la signatura de l\u2019acord<\/strong> de treball a dist\u00e0ncia, que haur\u00e0 de formalitzar-se per escrit, <strong>registrar-se a l\u2019oficina d\u2019ocupaci\u00f3 i entregar-se a la representaci\u00f3 legal<\/strong> de les persones treballadores.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Quins aspectes s\u00f3n rellevants i cal destacar d\u2019aquesta llei?<\/strong><\/h2>\n\n\n\n<ul class=\"justificar wp-block-list\"><li><strong>La voluntarietat del teletreball. <\/strong>&nbsp;Ser\u00e0 decisi\u00f3 de la persona treballadora i l\u2019empresa.<\/li><li>Les treballadores i els treballadors tindran <strong>dret a l\u2019abonament i a la compensaci\u00f3 de despeses<\/strong> per part de l\u2019empresa, en relaci\u00f3 amb la dotaci\u00f3 i el manteniment de les eines que permetin el desenvolupament de l\u2019activitat laboral. \u00c9s a dir, l\u2019empleat t\u00e9 dret a qu\u00e8 <strong>se li abonin les despeses pels equips, eines i mitjans vinculats al desenvolupament del treball<\/strong>.<\/li><li><strong>El teletreball ser\u00e0 reversible.<\/strong><\/li><li>Les empreses hauran de \u201c<strong>dotar de les eines, mitjans, equip i materials fungibles<\/strong>\u201d necessaris per a desenvolupar el treball a dist\u00e0ncia, com els ordinadors. Sobre la resta de despeses s\u2019apunta en una disposici\u00f3 transit\u00f2ria que es tractaran a trav\u00e9s de la negociaci\u00f3 col\u00b7lectiva.La ministra de treball, Yolanda D\u00edaz, va recollir a la roda de premsa posterior al Consell de Ministres que la norma \u201ciguala drets\u201d i ha insistit en qu\u00e8 <strong>les empreses s\u2019han de fer c\u00e0rrec de \u201ctotes les despeses\u201d necess\u00e0ries per a prestar el treball a dist\u00e0ncia i al seu manteniment.<\/strong><\/li><li><strong>La negociaci\u00f3 col\u00b7lectiva tindr\u00e0 un pes fonamental<\/strong> en aquest terreny, per a <strong>definir els requisits laborals<\/strong> que afavoreixen unes condicions de treball dignes.<\/li><li><strong>Dret al registre horari adequat<\/strong>. L\u2019inici i finalitzaci\u00f3 de la jornada de treball di\u00e0ria ha d\u2019estar clarament delimitada per assegurar que els treballadors compten amb un horari adequat. La desconnexi\u00f3 digital \u00e9s dret fonamental en el treball a dist\u00e0ncia.<\/li><li><strong>Haur\u00e0 de complir-se de manera m\u00e9s estricta, m\u00e9s encara si \u00e9s possible, la normativa de protecci\u00f3 de dades (RGPD i sobretot el T\u00edtol X LOPDGDD, de Drets Digitals).<\/strong><\/li><li><strong>El dret a la prevenci\u00f3 de riscos laborals. <\/strong>Avaluaci\u00f3 de riscos que haur\u00e0 de tenir en compte les conting\u00e8ncies caracter\u00edstiques d\u2019aquesta modalitat de treball, en especial factors psicosocials, ergon\u00f2mics i organitzatius.<\/li><li><strong>No seran causes justificatives de l\u2019extinci\u00f3 de la relaci\u00f3 laboral ni de la modificaci\u00f3 substancial de les condicions de treball la negativa de la persona treballadora a treballar a dist\u00e0ncia<\/strong>, l\u2019exercici de la reversibilitat al treball presencial i les dificultats per al desenvolupament adequat de l\u2019activitat laboral a dist\u00e0ncia, que estiguin exclusivament relacionades amb el canvi d\u2019una prestaci\u00f3 presencial a una altra que inclogui treball a dist\u00e0ncia.<\/li><\/ul>\n\n\n\n<p class=\"justificar wp-block-paragraph\">Des de Pymelegal <strong>posem a disposici\u00f3 dels clients el document &#8216;acord teletreball&#8217; <\/strong>per regularitzar aquesta modalitat amb els treballadors.
