{"id":7439,"date":"2019-12-05T09:00:35","date_gmt":"2019-12-05T07:00:35","guid":{"rendered":"http:\/\/davidp166.sg-host.com\/noticias\/sense-categoria\/privacitat-victimes-violencia-de-genere"},"modified":"2021-05-06T09:09:51","modified_gmt":"2021-05-06T07:09:51","slug":"privacitat-victimes-violencia-de-genere","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/privacitat-victimes-violencia-de-genere","title":{"rendered":"Privacitat v\u00edctimes viol\u00e8ncia de g\u00e8nere"},"content":{"rendered":"\n<h2 class=\"intro wp-block-heading\">Cada vegada, i per desgr\u00e0cia, s\u00f3n m\u00e9s freq\u00fcents titulars tipus \u201cavui s\u2019ha su\u00efcidat una dona degut a l\u2019assetjament patit per l\u2019enviament d\u2019un v\u00eddeo de la seva intimitat sexual\u201d; \u201cel cap de l\u2019empresa XXX assetja sexualment a les seves treballadores\u201d o incl\u00fas \u201cen el col.legi XXX s\u2019ha dif\u00f3s un v\u00eddeo d\u2019una alumna semi despullada\u201d.<\/h2>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">El passat 25 d\u2019octubre va ser el&nbsp;<strong>Dia Internacional de l\u2019Eliminaci\u00f3 de la Viol\u00e8ncia contra la Dona&nbsp;<\/strong>on es van proposar mesures per a&nbsp;<strong>fomentar la privacitat de les v\u00edctimes de viol\u00e8ncia de g\u00e8nere<\/strong>, dels assetjaments laborals i del ciberassetjament. Paral\u00b7lelament, l\u2019Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD) ha creat una guia amb una s\u00e8rie d\u2019<a rel=\"noreferrer noopener\" href=\"https:\/\/www.aepd.es\/prensa\/2019-11-22-iniciativas-fomento-privacidad-victimas-violencia-genero.html\" target=\"_blank\">iniciatives per a promoure la privacitat d\u2019aquestes v\u00edctimes<\/a>&nbsp;i aquesta setmana ens volem fer ress\u00f2 d\u2019ambdues iniciatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per al cas d\u2019assetjament en l\u2019\u00e0mbit&nbsp; laboral, us proposem el mateix problema vist&nbsp; des dels punts de vista de la v\u00edctima (i les seves actuacions) i de l\u2019empresa, sobre com es tracten aquestes dades sensibles i, les mesures i recomanacions que es poden dur a terme al voltant de la v\u00edctima per a no fomentar aquestes situacions.&nbsp; &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Com a primer escenari, des del punt de vista de la v\u00edctima, \u00bfcom li afecta la viol\u00e8ncia de g\u00e8nere o l\u2019assetjament en relaci\u00f3 a la vulneraci\u00f3 de la seva privacitat?<\/strong><br>Mitjan\u00e7ant la difusi\u00f3 en xarxes socials o internet de v\u00eddeos, dades o imatges d\u2019una v\u00edctima de viol\u00e8ncia de g\u00e8nere o assetjament s\u2019est\u00e0 vulnerant la seva privacitat. L\u2019AEPD posa a la seva disposici\u00f3 un&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/sedeagpd.gob.es\/sede-electronica-web\/vistas\/formNuevaReclamacion\/canalprioritario.jsf\" target=\"_blank\">Canal Prioritari<\/a>&nbsp;amb una s\u00e8rie de recomanacions que obren una nova via de&nbsp;<a href=\"https:\/\/www.pymelegal.es\/web\/ca\/noticias\/rgpd-ca\/proteccio-de-dades-sobre-imatges-il\u00b7licites\" target=\"_blank\" rel=\"noreferrer noopener\" aria-label=\" (abre en una nueva pesta\u00f1a)\">protecci\u00f3 de dades sobre imatges il\u00b7l\u00edcites<\/a>&nbsp;i d\u2019aquesta forma, con\u00e8ixer les&nbsp;<a href=\"https:\/\/www.pymelegal.es\/web\/ca\/noticias\/rgpd-ca\/consequencies-legals-de-la-difusio-de-contingut-sensible\">conseq\u00fc\u00e8ncies legals de la difusi\u00f3 de contingut sensible<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Com podem saber si la nostra privacitat est\u00e0 sent atacada?<\/strong><br>Per a protegir la nostra privacitat tenim les seg\u00fcents fonts:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8211;&nbsp;El tel\u00e8fon d\u2019ajuda a la v\u00edctima \u00e9s el 016<\/strong>&nbsp;(alguns smartphones ja tenen llistat aquest tel\u00e8fon com a trucada autom\u00e0tica).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211;&nbsp;Mesures que el govern ha impulsat a trav\u00e9s de diverses p\u00e0gines web, entre elles&nbsp;<a href=\"http:\/\/www.violenciagenero.igualdad.mpr.gob.es\/\" target=\"_blank\" rel=\"noreferrer noopener\">http:\/\/www.violenciagenero.igualdad.mpr.gob.es<\/a>, on es recullen diverses maneres de<strong>&nbsp;poder navegar amb mes tranquil\u00b7litat.<br><br>&#8211;&nbsp;<\/strong>Verificar que no tinguem instal\u00b7lada en el nostre&nbsp;<strong>dispositiu m\u00f2bil<\/strong>&nbsp;cap aplicaci\u00f3 tipus spyware o stalkerware que permetin a tercers obtenir informaci\u00f3 sobre el nostre historial de navegaci\u00f3, geolocalitzar-nos o incl\u00fas escoltar converses telef\u00f2niques. Algunes indicacions que ens poden ajudar a veure que el nostre dispositiu est\u00e0 sent \u201cespiat\u201d s\u00f3n, per exemple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211;&nbsp;Que la bateria duri menys de l\u2019habitual (tenint en compte que succeeix sense haver canviat l\u2019\u00fas regular del dispositiu o sense haver instal\u00b7lat aplicacions noves).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211;&nbsp;Que el m\u00f2bil es sobreescalfi de manera anormal (pot venir originat perqu\u00e8 el tel\u00e8fon estigui executant tasques de les que no som conscients).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211;&nbsp;Que el dispositiu s\u2019encengui i apagui \u201caparentment\u201d sol i es bloquegin o inhabilitin algunes aplicacions.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I, des del punt de vista de l\u2019empresa, \u00bfcom es pot incorporar la protecci\u00f3 de dades en les pol\u00edtiques empresarials de prevenci\u00f3 del assetjament?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019AEPD recull, en compliment de les funcions que li atribueix el RGPD en el seu article 57, les recomanacions de la&nbsp;<a href=\"https:\/\/www.aepd.es\/media\/protocolos\/recomendaciones-sobre-acoso-digital-aepd.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">protecci\u00f3 de dades com a garantia en les pol\u00edtiques de prevenci\u00f3 de l\u2019assetjament.<\/a>&nbsp;Les conductes a les que anem a referir-nos s\u00f3n&nbsp;<strong>assetjament laboral, sexual, per ra\u00f3 de sexe, per ra\u00f3 d\u2019orientaci\u00f3 sexual o per ra\u00f3 d\u2019identitat i expressi\u00f3 de g\u00e8nere<\/strong>&nbsp;quan aquestes es realitzin a trav\u00e9s de mitjans digitals per mitj\u00e0 de la gravaci\u00f3, difusi\u00f3 o publicaci\u00f3 de missatges o imatges que afectin a la intimitat o llibertat de la v\u00edctima en l\u2019\u00e0mbit laboral.<br>S\u2019ent\u00e9n que les conductes constitutives d\u2019assetjament es produeixen quan s\u2019envien a la v\u00edctima continguts degradants que atempten contra la seva dignitat (per exemple, amb l\u2019enviament de v\u00eddeos o imatges dels que es dedueix que es vulnera la seva dignitat i\/o llibertat sexual).<br>Les situacions d\u2019assetjament ja han sigut abordades legislativament en la Llei 31\/1995, de 8 de novembre, de prevenci\u00f3 de Riscos Laborals, en la qual s\u2019estableix l\u2019obligaci\u00f3 de les empreses de garantir la seguretat i salut dels empleats en els aspectes relacionats amb el treball, considerant que l\u2019assetjament laboral constitueix no sols un risc psicof\u00edsic per al treballador, sin\u00f3 un veritable atac a la seguretat i salut en el treball. La Llei Org\u00e0nica 3\/2007, de 22 de mar\u00e7, per a la igualtat efectiva de dones i homes, recull els mecanismes de prevenci\u00f3 contra l\u2019assetjament sexual i per ra\u00f3 de sexe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Les mesures que es recomanen a les empreses per a&nbsp; dur a terme s\u00f3n:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8211;&nbsp;Incloure en el comprom\u00eds de l\u2019empresa la protecci\u00f3 de dades i la igualtat de g\u00e8nere<\/strong>. L\u2019empresa garantir\u00e0 el compliment dels principis que recull el Reglament 2016\/679 del Parlament Europeu i del Consell de 27 d\u2019abril de 2016 en el seu article 5 de limitaci\u00f3, minimitzaci\u00f3, exactitud, conservaci\u00f3 i integritat i, confidencialitat de dades. Rebutjar\u00e0 usar dades quan la finalitat sigui inc\u00f3rrer en conductes d\u2019assetjament sexual i assetjament per ra\u00f3 de sexe o qualsevol \u00fas d\u2019aquestes dades contrari al dret a la privacitat i intimitat.<br>L\u2019entitat adquirir\u00e0 aix\u00ed el comprom\u00eds de prevenir, sensibilitzar i actuar en els sup\u00f2sits que tingui coneixement de ciberassetjament, ja sigui assetjament laboral o sexual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211;&nbsp;<strong>Mesures orientades a la prevenci\u00f3 del ciberassetjament:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>&nbsp;Incloure en les pol\u00edtiques de prevenci\u00f3 de l\u2019assetjament la descripci\u00f3 de les conductes inadequades en l\u2019\u00fas de les noves tecnologies, per a qu\u00e8 els empleats prenguin consci\u00e8ncia, i les conductes que puguin donar lloc a assetjament sexual, laboral o per ra\u00f3 de sexe; com per exemple, la gravaci\u00f3 d\u2019imatges que afectin a la intimitat dels treballadors o la difusi\u00f3 d\u2019imatges de contingut sexual entre els treballadors o l\u2019enviament de missatges que menyscabin la dignitat d\u2019un company de feina.<\/li><li>Incloure mecanismes de retirada de contingut que pugui suposar una situaci\u00f3 d\u2019assetjament, de forma \u00e0gil.<\/li><li>L\u2019entitat ha de minimitzar els tractaments de dades, especialment quan es tracti de dades d\u2019especial protecci\u00f3 que poguessin donar lloc, en cas d\u2019un mal \u00fas, a situacions d\u2019assetjament o discriminaci\u00f3.<\/li><li>Formacions als treballadors per a donar coneixement del ciberassetjament, del car\u00e0cter de falta o delicte de determinades conductes, aix\u00ed como mostrar-los conductes realitzades per mitj\u00e0 d\u2019Internet i xarxes socials que suposin casos d\u2019assetjament.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Quan la situaci\u00f3 s\u2019hagi originat, l\u2019organitzaci\u00f3 ha d\u2019iniciar els mecanismes de la prevenci\u00f3 de l\u2019assetjament amb les actuacions disciplin\u00e0ries als treballadors aix\u00ed com aplicar mesures orientades a l\u2019erradicaci\u00f3 del fet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Al seu torn, els empleats estaran exposats a les&nbsp;<strong>conseq\u00fc\u00e8ncies jur\u00eddiques<\/strong>, que poden anar des de les&nbsp;<strong>sancions administratives<\/strong>&nbsp;davant l\u2019AEPD, de&nbsp;<strong>responsabilitat laboral<\/strong>&nbsp;mitjan\u00e7ant sancions o acomiadaments, responsabilitat penal per inc\u00f3rrer en un&nbsp;<strong>delicte<\/strong>&nbsp;contra la integritat moral, descobriment de secrets o incl\u00fas, d\u2019assetjament sexual si fossin un mitj\u00e0 per a l\u2019obtenci\u00f3 de favors sexuals o responsabilitat civil pels danys i perjudicis causats a la persona afectada.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Els organismes p\u00fablics, les empreses i l\u2019AEPD prenen cartes davant les situacions d\u2019assetjament i ciberassetjament, davant el tractament de dades sensibles de forma adequada i davant situacions que suposen vulneracions de drets i llibertats de la v\u00edctima.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L\u2019equip de PYMELEGAL, S.L. es posa a la seva disposici\u00f3 per a q\u00fcestions relatives sobre aspectes de la not\u00edcia i modificaci\u00f3 de pol\u00edtiques de protecci\u00f3 de dades com a garantia de la prevenci\u00f3 de l\u2019assetjament.\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cada vegada, i per desgr\u00e0cia, s\u00f3n m\u00e9s freq\u00fcents titulars tipus \u201cavui s\u2019ha su\u00efcidat una dona degut a l\u2019assetjament patit per l\u2019enviament d\u2019un v\u00eddeo de la seva intimitat sexual\u201d;
