{"id":7395,"date":"2016-03-31T08:00:58","date_gmt":"2016-03-31T06:00:58","guid":{"rendered":"http:\/\/davidp166.sg-host.com\/noticias\/sense-categoria\/donar-referencies-dun-ex-empleat-vulnera-la-lopd"},"modified":"2021-05-06T09:09:59","modified_gmt":"2021-05-06T07:09:59","slug":"donar-referencies-dun-ex-empleat-vulnera-la-lopd","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/donar-referencies-dun-ex-empleat-vulnera-la-lopd","title":{"rendered":"Donar refer\u00e8ncies d&#8217;un ex-empleat vulnera la LOPD."},"content":{"rendered":"\n<h2 class=\"intro wp-block-heading\"><strong>Donar refer\u00e8ncies d&#8217;un ex-empleat, tot i que sigui una pr\u00e0ctica habitual i socialment acceptada, pot convertir-se en potencialment perillosa.<\/strong><\/h2>\n\n\n\n<!--more-->\n\n\n\n<p>Tot i que abans es permetia,\u00a0<strong><span style=\"text-decoration: underline;\">a dia d&#8217;avui atendre el requeriment d&#8217;una altra empresa que ens demana informaci\u00f3 sobre un ex-empleat nostre, amb independ\u00e8ncia que aquestes refer\u00e8ncies vagin a ser negatives o favorables per a aquest, pot suposar la comissi\u00f3 de m\u00e9s d&#8217;una infracci\u00f3 de la LOPD<\/span><\/strong><span style=\"text-decoration: underline;\">.<\/span><br><br>De fet, en lliurar aquesta informaci\u00f3 estem realitzant una cessi\u00f3 de dades del treballador (art. 11 de la LOPD) per a la qual necessitem el seu previ consentiment. Aix\u00f2 \u00e9s aix\u00ed perqu\u00e8 aquesta cessi\u00f3 de dades no \u00e9s en absolut necess\u00e0ria per al manteniment o compliment de la relaci\u00f3 laboral que manten\u00edem amb el treballador, que ja ha finalitzat. Per tant,\u00a0<strong><span style=\"text-decoration: underline;\">a partir del moment en qu\u00e8 finalitza la relaci\u00f3 laboral amb un treballador, tot el que vulguem fer amb les seves dades personals, llevat que estigui emparat per una llei, haur\u00e0 de comptar amb el seu consentiment previ<\/span><\/strong>.<br><br>Els riscos concrets s\u00f3n els seg\u00fcents:<br><br>(i) D&#8217;entrada, tal com hem apuntat, estar\u00edem cometent una cessi\u00f3 il\u00b7l\u00edcita de dades, tipificada com a molt greu a l&#8217;article 44.4.b) de la LOPD;\u00a0<br>(Ii) L&#8217;Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD) tamb\u00e9 podria qualificar aquesta acci\u00f3 com un tractament de dades realitzat sense el consentiment de l&#8217;afectat, tipificat com a greu en l&#8217;article 44.3.d) de la LOPD;\u00a0<br>(Iii) Finalment, qualsevol de les infraccions anteriors portaria aparellada una vulneraci\u00f3 del deure de secret que estableix l&#8217;article 10 de la LOPD, tipificat com a lleu en l&#8217;article 44.2.e) de la LOPD.<br><br>Cal tindre en compte que davant de situacions similars, l&#8217;AEPD ha aplicat l&#8217;article 4.4 del Reial Decret 1398\/1993, de 4 d&#8217;agost, pel qual s&#8217;aprova el Reglament del Procediment per a l&#8217;Exercici de la potestat sancionadora, segons el qual &#8220;en defecte de regulaci\u00f3 espec\u00edfica establerta en la norma corresponent, quan de la comissi\u00f3 d&#8217;una infracci\u00f3 derivi necess\u00e0riament la comissi\u00f3 d&#8217;una altra o d&#8217;altres, caldr\u00e0 imposar \u00fanicament la sanci\u00f3 corresponent a la infracci\u00f3 m\u00e9s greu comesa&#8221;.<br><br>Per tant,\u00a0<strong><span style=\"text-decoration: underline;\">si volem donar refer\u00e8ncies<\/span><\/strong>\u00a0dels nostres ex-empleats ser\u00e0 necessari articular un mecanisme que permeti a l&#8217;empresa\u00a0<strong><span style=\"text-decoration: underline;\">demostrar en cas de necessitat, que el seu ex-empleat pr\u00e8viament li ha autoritzat<\/span><\/strong>\u00a0per poder facilitar informaci\u00f3 personal seva a una tercera empresa, amb la finalitat concreta de donar refer\u00e8ncies en el marc d&#8217;un proc\u00e9s de selecci\u00f3 de personal.
