{"id":7344,"date":"2018-12-27T09:00:46","date_gmt":"2018-12-27T07:00:46","guid":{"rendered":"http:\/\/davidp166.sg-host.com\/noticias\/sense-categoria\/drets-digitals-ii-ambit-laboral"},"modified":"2021-05-06T09:09:55","modified_gmt":"2021-05-06T07:09:55","slug":"drets-digitals-ii-ambit-laboral","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/drets-digitals-ii-ambit-laboral","title":{"rendered":"Drets digitals II: \u00e0mbit laboral"},"content":{"rendered":"\n<h2 class=\"intro wp-block-heading\"><strong>Seguint amb el segon cap\u00edtol&nbsp;de Garantia dels Drets Digitals, recollits en el T\u00edtol X de la LOPDGDD, avui tractarem l&#8217;apartat sobre&nbsp;&#8216;El dret digital en l&#8217;\u00e0mbit laboral&#8217;.<\/strong><\/h2>\n\n\n\n<!--more-->\n\n\n\n<p class=\"wp-block-paragraph\">S&#8217;apunta dins de l&#8217;\u00e0mbit laboral a cinc \u00e0rees de regulaci\u00f3 que suposen un avan\u00e7 en la mat\u00e8ria de Desconnexi\u00f3 digital i intimitat pels treballadors. Passem doncs a detallar-los:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1. Dret a la intimitat i \u00fas de dispositius digitals&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La nova LOPDGDD regula en l&#8217;article 87, qu\u00e8 pot fer&nbsp;<strong>l\u2019empresari&nbsp;<\/strong>respecte a l<strong>&#8216;acc\u00e9s als continguts<\/strong>&nbsp;dipositats en els mitjans digitals que aquest ha facilitat els treballadors, pel compliment de les obligacions laborals o estatut\u00e0ries i poder garantir la integritat dels dispositius.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per a procedir a aquest acc\u00e9s, els empresaris hauran d&#8217;establir criteris d&#8217;\u00fas dels dispositius de manera pr\u00e8via, complint aix\u00ed amb el deure d&#8217;informaci\u00f3 al treballador, i sempre respectant els l\u00edmits de la protecci\u00f3 de la intimitat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Per exemple, l\u2019empresari pot establir com a criteri, una revisi\u00f3 peri\u00f2dica dels discs durs o de les connexions a internet quan sigui necessari per a la protecci\u00f3 del patrimoni empresarial o dels drets de la resta de professionals, o per motius de funcionament de l&#8217;organitzaci\u00f3. Aquestes revisions, han de tenir un m\u00ednim de garanties legals d&#8217;acord amb la normativa legal vigent en protecci\u00f3 de dades, i ha de realitzar-se per professionals t\u00e8cnics o persones expressament autoritzades per l&#8217;organitzaci\u00f3.&nbsp;<br>Tot aix\u00f2 ha d&#8217;anar acompanyat d&#8217;una normativa interna que ha de lliurar com coment\u00e0vem, l\u2019empresari als treballadors, sobre l&#8217;\u00fas i acc\u00e9s als sistemes, l&#8217;emmagatzematge d&#8217;informaci\u00f3, l&#8217;\u00fas del correu, instal\u00b7laci\u00f3 de programes no autoritzats per l&#8217;organitzaci\u00f3, entre altres aspectes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2. Dret a la desconnexi\u00f3 digital<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En el seg\u00fcent article de la LOPDGDD, el 88, es pret\u00e9n regular la Desconnexi\u00f3 digital. Podem definir aquest concepte com la limitaci\u00f3 a l&#8217;\u00fas de les tecnologies de la comunicaci\u00f3 per a garantir el temps de descans, permisos i vacances dels treballadors, aix\u00ed com la intimitat personal i familiar.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amb la nova LOPDGDD s&#8217;han modificat el Reial Decret Legislatiu 2\/2015, de 23 d&#8217;octubre, pel qual s&#8217;aprova el text ref\u00f3s de la Llei de l&#8217;Estatut dels Treballadors, afegint l&#8217;article 20 bis \u00ab<em><strong>Derechos de los trabajadores a la intimidad en relaci\u00f3n con el entorno digital y a la desconexi\u00f3n<\/strong>. Los trabajadores tienen derecho a la intimidad en el uso de los dispositivos digitales puestos a su disposici\u00f3n por el empleador, a la&nbsp;<strong>desconexi\u00f3n digital y a la intimidad<\/strong>&nbsp;frente al uso de dispositivos de videovigilancia y geolocalizaci\u00f3n en los t\u00e9rminos establecidos en la legislaci\u00f3n vigente en materia de protecci\u00f3n de datos personales y garant\u00eda de los derechos digitales<\/em>.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S&#8217;ha modificat tamb\u00e9 el Reial decret legislatiu 5\/2015, de 30 d&#8217;octubre, pel qual s&#8217;aprova el text ref\u00f3s de la Llei de l&#8217;Estatut B\u00e0sic de l&#8217;Empleat p\u00fablic, afegint l&#8217;apartat j) bis a l&#8217;article 14 el dret \u201c<em>A la&nbsp;<strong>intimidad&nbsp;<\/strong>en el uso de dispositivos digitales puestos a su disposici\u00f3n y frente al uso de dispositivos de videovigilancia y geolocalizaci\u00f3n, as\u00ed como a la&nbsp;<strong>desconexi\u00f3n digital&nbsp;<\/strong>en los t\u00e9rminos establecidos en la legislaci\u00f3n vigente en materia de protecci\u00f3n de datos personales y garant\u00eda de los derechos digitales<\/em>.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aquesta desconnexi\u00f3 digital pret\u00e9n&nbsp;<strong>conciliar activitat laboral amb vida personal i familiar,<\/strong>&nbsp;i tot aix\u00f2 se subjectar\u00e0 al que s&#8217;estableix en la negociaci\u00f3 col\u00b7lectiva o en defecte d&#8217;aix\u00f2 a l&#8217;acordat entre empresa i representants dels treballadors. Pel que l\u2019empresari junt amb els comentaris dels representants dels treballadors ha de:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Elaborar una pol\u00edtica pels treballadors, inclosos els que ocupin llocs directius, per&nbsp; establir el dret a la desconnexi\u00f3,&nbsp;<\/li><li>A m\u00e9s, s&#8217;establir\u00e0 un pla de formaci\u00f3&nbsp;<\/li><li>Sensibilitzaci\u00f3 del personal<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Tot aix\u00f2 per garantir i fomentar un \u00fas raonable de les eines tecnol\u00f2giques.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">S&#8217;estableix aquest dret, sobretot, per a aquells sup\u00f2sits laborals que tinguin una jornada total o parcial a dist\u00e0ncia, en el domicili de l&#8217;empleat, que tingui vinculaci\u00f3 amb eines tecnol\u00f2giques amb finalitats laborals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3. Dret a la intimitat enfront de l&#8217;\u00fas de dispositius de videovigil\u00e0ncia i d&#8217;enregistrament de sons en el lloc de treball<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">El dret de l\u2019empresari a la&nbsp;<strong>vigil\u00e0ncia i control<\/strong>&nbsp;est\u00e0 emparat per l&#8217;article 20.3 de l&#8217;Estatut dels Treballadors, i en la legislaci\u00f3 de funci\u00f3 p\u00fablica tamb\u00e9, per poder verificar el compliment de les obligacions i deures laborals. Tot aix\u00f2 ha d&#8217;anar acompanyat per part de l\u2019empresari del deure&nbsp;<strong>d&#8217;informaci\u00f3<\/strong>, de forma pr\u00e8via, expressa, clara i concisa al treballador o empleat p\u00fablic o al seu representant si escau; i tamb\u00e9 de l\u00edmits, com la instal\u00b7laci\u00f3 de dispositius de videovigil\u00e0ncia o d&#8217;enregistrament de sons en llocs com vestuaris, serveis, menjadors i an\u00e0legs, que no ser\u00e0 adm\u00e8s en cap cas. L&#8217;\u00fas d&#8217;aquests dispositius d&#8217;enregistrament d&#8217;imatges i so ser\u00e0 adm\u00e8s sempre respectant el principi de proporcionalitat i d&#8217;intervenci\u00f3 m\u00ednima juntament amb les garanties anteriorment descrites, i quan resultin&nbsp;<strong>rellevants per a la seguretat de les instal\u00b7lacions, b\u00e9ns i persones&nbsp;<\/strong>derivats de l&#8217;activitat que l&#8217;empresa desenvolupi.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recordem que la videovigil\u00e0ncia \u00e9s un tractament que implica la necessitat d&#8217;informaci\u00f3 a trav\u00e9s de&nbsp;<em><strong>col\u00b7locaci\u00f3 d&#8217;un dispositiu informatiu en un lloc prou visible<\/strong>&nbsp;identificant, almenys, l&#8217;exist\u00e8ncia del tractament, la identitat del responsable i la possibilitat d&#8217;exercitar els drets previstos en els articles 15 a 22 del Reglament (UE) 2016\/679. Tamb\u00e9 podr\u00e0 incloure&#8217;s en el dispositiu informatiu un codi de connexi\u00f3 o adre\u00e7a d&#8217;internet a aquesta informaci\u00f3<\/em>&nbsp;(article 22.4 de la LOPDGDD).&nbsp;<br>El tractament tamb\u00e9 implica la&nbsp;<strong>supressi\u00f3&nbsp;<\/strong>de les dades en el&nbsp;<em>termini&nbsp;<strong>m\u00e0xim d&#8217;un mes&nbsp;<\/strong>excepte quan haguessin de ser conservades per acreditar la comissi\u00f3 d&#8217;actes que atemptin contra la integritat de persones, b\u00e9ns o instal\u00b7lacions. En tal cas, les imatges hauran de ser posades a&nbsp; disposici\u00f3 de l&#8217;autoritat competent en un termini m\u00e0xim de setanta-dues hores des que es tingu\u00e9s coneixement de l&#8217;exist\u00e8ncia de l&#8217;enregistrament&nbsp;<\/em>(article 22.3 LOPDGDD).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>4. Dret a la intimitat davant la utilitzaci\u00f3 de sistemes de geolocalitzaci\u00f3 en l&#8217;\u00e0mbit laboral.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dret emparat en l&#8217;article 20.3 de l&#8217;Estatut dels Treballadors, com l&#8217;anterior dret, i en la legislaci\u00f3 de funci\u00f3 p\u00fablica tamb\u00e9, per a les funcions de control a trav\u00e9s de sistemes de&nbsp;<strong>geolocalitzaci\u00f3<\/strong>, sempre d&#8217;acord als l\u00edmits del marc legal, i sempre per part de l\u2019empresari havent complert les obligacions&nbsp;<strong>d&#8217;informaci\u00f3&nbsp;<\/strong>de forma pr\u00e8via, expressa, clara i concisa al treballador o empleat p\u00fablic o al seu representant si escau, juntament amb l&#8217;exercici dels drets dels interessats corresponents, i al costat de les caracter\u00edstiques dels dispositius que realitzen la geolocalitzaci\u00f3.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5. Drets digitals en la negociaci\u00f3 col\u00b7lectiva<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Basat en&nbsp;<strong>l&#8217;autoregulaci\u00f3&nbsp;<\/strong>i la informaci\u00f3 i&nbsp;<strong>acceptaci\u00f3 individual,<\/strong>&nbsp;\u00e9s un article molt general que obre una fase pr\u00e0ctica en la qual a poc a poc s&#8217;aniran actualitzant les pol\u00edtiques internes de les organitzacions i aniran entrant en la negociaci\u00f3 col\u00b7lectiva.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La regulaci\u00f3 dels drets comentats suposa un avan\u00e7 i una nova etapa en regulaci\u00f3 i canvi en les organitzacions, el treball i els treballadors, que ja existia en altres pa\u00efsos com Fran\u00e7a, en el qual en 2017 va entrar en vigor la reforma de la norma laboral francesa introduint el dret a la desconnexi\u00f3 digital del treballador.\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Seguint amb el segon cap\u00edtol&nbsp;de Garantia dels Drets Digitals, recollits en el T\u00edtol X de la LOPDGDD, avui tractarem l&#8217;apartat sobre&nbsp;&#8216;El dret digital en l&#8217;\u00e0mbit laboral&#8217;.<\/p>\n","protected":false},"author":3,"featured_media":6772,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"content-type":"","footnotes":""},"categories":[115],"tags":[],"class_list":["post-7344","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-rgpd-ca"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.8 -
