{"id":7309,"date":"2019-05-18T08:00:27","date_gmt":"2019-05-18T06:00:27","guid":{"rendered":"http:\/\/davidp166.sg-host.com\/noticias\/sense-categoria\/control-horari-i-proteccio-de-dades"},"modified":"2021-05-06T09:09:53","modified_gmt":"2021-05-06T07:09:53","slug":"control-horari-i-proteccio-de-dades","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/control-horari-i-proteccio-de-dades","title":{"rendered":"Control horari i protecci\u00f3 de dades"},"content":{"rendered":"\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Fa unes setmanes, vam comentar el canvi que suposava la LOPDGDD en relaci\u00f3 a la\u00a0<a href=\"https:\/\/www.pymelegal.es\/web\/ca\/noticias\/rgpd-ca\/drets-digitals-ii-ambit-laboral\">desconnexi\u00f3 laboral,<\/a>\u00a0i ara tenim entre mans el canvi normatiu que introduir\u00e0 el Reial Decret Llei 8\/2019, de 8 de mar\u00e7, de mesures urgents de protecci\u00f3 social i de lluita contra la precarietat laboral a la <strong>jornada de treball<\/strong>, en relaci\u00f3 al control de la jornada laboral, i que en conseq\u00fc\u00e8ncia suposa actualitzar la documentaci\u00f3 en protecci\u00f3 de dades en els punts que passem a comentar.\u00a0<\/p><\/blockquote>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\">Context normatiu<\/h2>\n\n\n\n<p>Aquest Reial Decret, ve a <strong>regular el registre de la jornada laboral <\/strong>com mesura per combatre la precarietat en el treball, ja que la realitzaci\u00f3 de m\u00e9s hores de les pactades en el contracte suposa dues afectacions: el salari i a la dificultat de conciliar la vida personal. Tanmateix, la creaci\u00f3 d\u2019aquest registre, assegura la conformitat de la normativa espanyola i l\u2019ordenament europeu.\u00a0<\/p>\n\n\n\n<p>Exactament el canvi normatiu ve establert a l\u2019article 10 del citat RDL, que modifica el text ref\u00f3s de la Llei de l\u2019Estatut dels Treballadors, aprovat pel Reial Decret Legislatiu 2\/2015, de 23 d\u2019octubre, als efectes de garantir el <strong>compliment dels l\u00edmits en sobre la jornada<\/strong>, de crear un marc de seguretat jur\u00eddica tant per les persones treballadores, com per les empreses i de possibilitar el control per part de la Inspecci\u00f3 de Treball i Seguretat Social.\u00a0\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Principi de proactivitat en acci\u00f3<\/h2>\n\n\n\n<p>Per donar compliment al principi de proactivitat contemplat al RGPD, al seu article 5, hem de dur a terme els canvis en relaci\u00f3 al tractament de dades relacionat amb el control de la jornada laboral, i aquests s\u00f3n:&nbsp;<\/p>\n\n\n\n<p>&#8211;&nbsp;<strong>Respecte al tractament de dades<\/strong>: Si \u00e9s un nou tractament de dades, s\u2019haur\u00e0 de crear un Registre d\u2019Activitat de Tractament, que registri aquest tractament, o<br>si es un tractament ja existent, modificar els que ja ten\u00edem de RRHH i afegir el control&nbsp; horari.&nbsp;<br>Pel cas que es decideix posar un control d\u2019acc\u00e9s a trav\u00e9s d\u2019empremta dactilar, recordar que aquesta tipologia de dades esta dins de la categoria d\u2019especialment sensible, i que per tant recomanem crear un nou tractament a part del de treballadors, i informar al treballador del control d\u2019acc\u00e9s mitjan\u00e7ant l\u2019\u00fas de dada biom\u00e8trica.&nbsp;<\/p>\n\n\n\n<p>&#8211;&nbsp;<strong>Respecto a l\u2019an\u00e0lisi de riscos<\/strong>: haurem de modificar o fer un an\u00e0lisis de riscos sobre aquest tractament, i en conseq\u00fc\u00e8ncia aplicar les mesures de seguretat corresponents per salvaguardar aquestes dades.<\/p>\n\n\n\n<p>&#8211;&nbsp;<strong>Modificaci\u00f3 dels usuaris autoritzats<\/strong>: Haurem d\u2019identificar qui t\u00e9 acc\u00e9s a les dades, ja que no m\u00e9s haur\u00e0 de tenir-ne el personal autoritzat.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&#8211;&nbsp;<strong>Firma del contracte d\u2019encarregat de tractament:<\/strong>&nbsp;Firmar amb l\u2019empresa prestadora d\u2019aquest servei (si hi ha) el contracte d\u2019Encarregat de Tractament. Per exemple, en el caso d\u2019acc\u00e9s amb empremta dactilar, si aquest servei es presta a trav\u00e9s d\u2019un software de tercers, haurem de signar el corresponent contracte de prestaci\u00f3 de serveis d\u2019encarregat de tractament.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&#8211;&nbsp;<strong>Compliment del deure d\u2019informaci\u00f3<\/strong>: Informar pr\u00e8viament als treballadors d\u2019aquest nou tractament, de com podran exercitar els seus drets i tenir en compte que, ens els casos en els que el software escollit sigui una App i puguin apar\u00e8ixer dades de geolocalitzaci\u00f3 (per exemple), tamb\u00e9 s\u2019ha d\u2019informar als treballadors.&nbsp;<br><br>&#8211;&nbsp;<strong>Protocol\u00b7litzaci\u00f3 del procediment<\/strong>: Establir un protocol senzill per facilitar al treballador una c\u00f2pia del quadre mensual de les hores realitzades, junt amb l\u2019entrega d ela n\u00f2mina, per exemple.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&#8211;\u00a0<strong>Protocol de conservaci\u00f3\/supressi\u00f3<\/strong>:\u00a0El sistema d\u2019 arxiu d\u2019aquestes dades (si \u00e9s automatitzat o manual) ha de tenir algun sistema per que, un cop aquestes dades ja no siguin necess\u00e0ries, i hagi passat el temps legalment establert (4 anys, segons l\u2019establert per la normativa) podran suprimir-se\u00a0 Durant aquests 4 anys, han d\u2019estar a disposici\u00f3 dels organismes que ho sol\u00b7licitin, tal i como marca la modificaci\u00f3 de l\u2019article 34 del Text Ref\u00f3s de la Llei de l\u2019Estatut dels Treballadors, aprovat pel Reial Decret Legislatiu 2\/2015, de 23 d\u2019octubre, afegint un nou apartat, el 9 amb la seg\u00fcent redacci\u00f3:<\/p>\n\n\n\n<p>\u201c\u2026<em>La empresa conservar\u00e1 los registros a que se refiere este precepto durante cuatro a\u00f1os y permanecer\u00e1n a disposici\u00f3n de las personas trabajadoras, de sus representantes legales y de la Inspecci\u00f3n de Trabajo y Seguridad Social<\/em>.\u201d<\/p>\n\n\n\n<p>S\u2019haur\u00e0 d\u2019establir un protocol a seguir al produir-se la baixa del treballador, que permeti bloquejar aquestes dadesfins que el citat termini de venciment, de 4 anys, arribi.\u00a0<\/p>\n\n\n\n<p>Encara tenim temps d\u2019actualitzar-nos, donat que el canvi normatiu entrar\u00e0 en vigor a partir del 12 de maig.\u00a0<a href=\"https:\/\/www.pymelegal.es\/ca\/contactar-lopd\">Parlem<\/a>?<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Fa unes setmanes, vam comentar el canvi que suposava la LOPDGDD en relaci\u00f3 a la\u00a0desconnexi\u00f3 laboral,\u00a0i ara tenim entre mans el canvi normatiu que introduir\u00e0 el Reial Decret Llei 8\/2019, de 8 de mar\u00e7, de mesures urgents de protecci\u00f3 social i de lluita contra la precarietat laboral a la jornada de treball, en relaci\u00f3 al &#8230; <a title=\"Control horari i protecci\u00f3 de dades\" class=\"read-more\" href=\"https:\/\/www.pymelegal.es\/ca\/noticias\/rgpd-ca\/control-horari-i-proteccio-de-dades\" aria-label=\"M\u00e9s informaci\u00f3 sobre Control horari i protecci\u00f3 de dades\">Read more<\/a><\/p>\n","protected":false},"author":3,"featured_media":7310,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"content-type":"","footnotes":""},"categories":[115],"tags":[],"class_list":["post-7309","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-rgpd-ca"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
