{"id":17163,"date":"2026-05-22T11:41:27","date_gmt":"2026-05-22T09:41:27","guid":{"rendered":"https:\/\/www.pymelegal.es\/?p=17163"},"modified":"2026-05-22T11:41:27","modified_gmt":"2026-05-22T09:41:27","slug":"les-sancions-rgpd-mes-altes-a-espanya-el-2025-laepd-endureix-la-seva-actuacio-davant-bretxes-de-seguretat-i-tractaments-il%c2%b7licits","status":"publish","type":"post","link":"https:\/\/www.pymelegal.es\/ca\/noticias\/aepd-ca\/les-sancions-rgpd-mes-altes-a-espanya-el-2025-laepd-endureix-la-seva-actuacio-davant-bretxes-de-seguretat-i-tractaments-il%c2%b7licits","title":{"rendered":"Les sancions RGPD m\u00e9s altes a Espanya el 2025: l\u2019AEPD endureix la seva actuaci\u00f3 davant bretxes de seguretat i tractaments il\u00b7l\u00edcits"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">L\u2019Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD) ha tancat el 2025 amb una <\/span><b>xifra r\u00e8cord de reclamacions<\/b><span style=\"font-weight: 400;\"> i un dels anys m\u00e9s durs en mat\u00e8ria sancionadora des de l\u2019entrada en vigor del Reglament General de Protecci\u00f3 de Dades (RGPD).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Segons la Mem\u00f2ria 2025 publicada per la mateixa Ag\u00e8ncia, durant aquest any <\/span><b>es van rebre m\u00e9s de 30.931 reclamacions, un 64% m\u00e9s que el 2024<\/b><span style=\"font-weight: 400;\">, reflectint un creixement hist\u00f2ric de conflictes relacionats amb privacitat, bretxes de seguretat, videovigil\u00e0ncia, publicitat no desitjada i tractaments il\u00b7leg\u00edtims de dades personals.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A m\u00e9s, les multes econ\u00f2miques tamb\u00e9 es van disparar. L\u2019import total de sancions va arribar als <\/span><b>48,1 milions d\u2019euros, un 35% m\u00e9s que l\u2019any anterior<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En aquest article analitzem:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">quines han estat les sancions RGPD m\u00e9s elevades a Espanya el 2025,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">quines infraccions es repeteixen amb m\u00e9s freq\u00fc\u00e8ncia,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">quins sectors estan m\u00e9s exposats,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i quines lli\u00e7ons han d\u2019aprendre empreses i pimes per evitar multes milion\u00e0ries.<\/span><\/li>\n<\/ul>\n<h3><b>Un any r\u00e8cord per a la protecci\u00f3 de dades a Espanya<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">L\u2019AEPD reconeix a la seva mem\u00f2ria anual que l\u2019augment de reclamacions ha estat \u201cespectacular\u201d, fins al punt de reduir la taxa de resoluci\u00f3 a causa del volum d\u2019expedients acumulats.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les dades m\u00e9s rellevants de 2025 s\u00f3n contundents:<\/span><\/p>\n<ul>\n<li><b>30.931 reclamacions presentades<\/b><span style=\"font-weight: 400;\"> davant l\u2019AEPD (+64%)<\/span><\/li>\n<li><b>23.361 reclamacions resoltes<\/b><\/li>\n<li><b>495 procediments sancionadors<\/b><span style=\"font-weight: 400;\"> i apercebiments<\/span><\/li>\n<li><b>48,1 milions d\u2019euros<\/b><span style=\"font-weight: 400;\"> en multes<\/span><\/li>\n<li><b>326 sancions econ\u00f2miques<\/b><span style=\"font-weight: 400;\"> imposades<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Multa mitjana de 148.000 euros (+17%)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">La mateixa Ag\u00e8ncia assenyala que l\u2019augment de la complexitat tecnol\u00f2gica i de les bretxes de seguretat est\u00e0 darrere de l\u2019enduriment de les actuacions inspectores.<\/span><\/p>\n<h3><b>Les 10 sancions RGPD m\u00e9s altes a Espanya el 2025<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Aquestes han estat les multes m\u00e9s elevades publicades per l\u2019AEPD durant el style=\"font-weight: 400;\">La sanci\u00f3 m\u00e9s alta del 2025 va ser per a AENA, amb <\/span><b>m\u00e9s de 10 milions d\u2019euros per infracci\u00f3 de l\u2019article 35 del RGPD<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aquest article regula l\u2019<\/span><b>obligaci\u00f3 de realitzar Avaluacions d\u2019Impacte en Protecci\u00f3 de Dades (AIPD)<\/b><span style=\"font-weight: 400;\"> quan un tractament pot implicar un alt risc per als drets i llibertats de les persones.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La quantia reflecteix una tend\u00e8ncia clara: l\u2019AEPD ja no nom\u00e9s sanciona bretxes de seguretat o spam, sin\u00f3 tamb\u00e9 <\/span><b>errors estructurals de compliment preventiu<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Les bretxes de seguretat dominen les grans sancions<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Un dels aspectes m\u00e9s rellevants del 2025 ha estat el fort increment d\u2019expedients relacionats amb ciberseguretat i filtracions de dades.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019AEPD afirma que:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les <\/span><b>actuacions pr\u00e8vies<\/b><span style=\"font-weight: 400;\"> d\u2019investigaci\u00f3 per bretxes van augmentar un 69%,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">els <\/span><b>procediments sancionadors <\/b><span style=\"font-weight: 400;\">van cr\u00e9ixer un 157%,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i l\u2019<\/span><b>import total de multes <\/b><span style=\"font-weight: 400;\">vinculades a bretxes va arribar a gaireb\u00e9 20 milions d\u2019euros.<\/span><\/li>\n<\/ul>\n<h2><b>Xfera M\u00f3viles: 4 milions d\u2019euros per un ciberatac<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Xfera M\u00f3viles (Yoigo) va rebre una de les sancions m\u00e9s altes de l\u2019any: <\/span><b>4 milions d\u2019euros per infracci\u00f3 dels articles 5.1.f i 32 del RGPD<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">L\u2019AEPD va concloure que existien <\/span><b>defici\u00e8ncies en les mesures t\u00e8cniques i organitzatives destinades<\/b><span style=\"font-weight: 400;\"> a garantir la seguretat de les dades personals despr\u00e9s d\u2019un ciberatac.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El cas \u00e9s especialment rellevant perqu\u00e8 demostra que:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">patir un atac no eximeix de responsabilitat,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i les empreses han d\u2019acreditar mesures de seguretat adequades i proporcionades al risc.<\/span><\/li>\n<\/ul>\n<h2><b>Carrefour i les bretxes de dades: 3,2 milions d\u2019euros<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Centros Comerciales Carrefour va ser <\/span><b>sancionada amb 3,2 milions d\u2019euros per vulneracions <\/b><span style=\"font-weight: 400;\">relacionades amb:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">confidencialitat,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">mesures de seguretat,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i manca de notificaci\u00f3 adequada de bretxes.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">L\u2019AEPD considera especialment greu:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">no protegir correctament les dades,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">no minimitzar l\u2019impacte de la filtraci\u00f3,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">o no informar adequadament les persones afectades.<\/span><\/li>\n<\/ul>\n<h2><b>Sprinter: milions d\u2019usuaris afectats<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Un dels <\/span><b>expedients m\u00e9s medi\u00e0tics del 2025<\/b><span style=\"font-weight: 400;\"> va ser el de Sprinter Megacentros del Deporte.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La bretxa va afectar:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">4 milions de persones a Espanya,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">6 milions a la UE,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">incloent categories especials i dades sensibles.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">La <\/span><b>sanci\u00f3 total va superar els 1,5 milions d\u2019euros<\/b><span style=\"font-weight: 400;\">, tot i que la mem\u00f2ria tamb\u00e9 menciona imports superiors derivats del mateix cas en el context transfronterer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La resoluci\u00f3 posa el focus en:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">mesures t\u00e8cniques insuficients,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">mala gesti\u00f3 del risc,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">i manca de protecci\u00f3 efectiva d\u2019informaci\u00f3 sensible.<\/span><\/li>\n<\/ul>\n<h3><b>El gran problema del 2025: seguretat i confidencialitat<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">La majoria de les grans multes comparteixen un mateix patr\u00f3: errors en seguretat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Els articles m\u00e9s sancionats han estat:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">article 5.1.f RGPD \u2192 integritat i confidencialitat,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">article 32 \u2192 seguretat del tractament,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">article 34 \u2192 obligaci\u00f3 de comunicar bretxes,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">article 25 \u2192 privacitat des del disseny.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">L\u2019AEPD deixa clar que les empreses ja no poden limitar-se a \u201ctenir documents RGPD\u201d, sin\u00f3 que han de demostrar mesures reals de protecci\u00f3.<\/span><\/p>\n<h3><b>Sectors m\u00e9s sancionats el 2025<\/b><\/h3>\n<p><span style=\"font-weight: style=\"font-weight: 400;\">i bretxes de seguretat (+348%).<\/span><\/li>\n<\/ul>\n<h3><b>Les reclamacions m\u00e9s freq\u00fcents davant l\u2019AEPD<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">L\u2019Ag\u00e8ncia tamb\u00e9 detalla les \u00e0rees que m\u00e9s reclamacions generen entre la ciutadania:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span continu de conflictes relacionats amb Internet i privacitat digital.<\/span><\/li>\n<\/ul>\n<h3><b>Qu\u00e8 pot aprendre una pime d\u2019aquestes sancions?<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Tot i que moltes de les multes afecten grans companyies, la realitat \u00e9s que les obligacions del RGPD tamb\u00e9 afecten petites i mitjanes empreses.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I l\u2019AEPD insisteix cada vegada m\u00e9s en aspectes t\u00e8cnics i organitzatius com:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span
