Requisits legals, sancions i RGPD"},"content":{"rendered":"<h2><strong>Qu\u00e8 \u00e9s i per qu\u00e8 \u00e9s obligatori?<\/strong><\/h2>\n<p>Des del 2007, la <strong>Llei Org\u00e0nica 3\/2007, per a la igualtat efectiva de dones i homes<\/strong>, obliga totes les empreses \u2014independentment del seu tamany\u2014 a disposar d\u2019un <strong>protocol d\u2019actuaci\u00f3 contra l\u2019assetjament laboral<\/strong>.<\/p>\n<p>Des de 2020, amb el <strong>Reial Decret 901\/2020<\/strong>, \u00e9s obligatori incloure el protocol dins el Pla d\u2019Igualtat a les empreses de m\u00e9s de 50 treballadors. I el nou RD 1026\/2024 refor\u00e7a aquesta obligaci\u00f3 per a les empreses de m\u00e9s de 50 treballadors, exigint que els protocols incloguin mesures espec\u00edfiques contra l\u2019assetjament i la viol\u00e8ncia vers les persones LGTBI.<\/p>\n<p>Aquest protocol ha de cobrir espec\u00edficament <strong>l\u2019assetjament sexual i l\u2019assetjament per ra\u00f3 de sexe<\/strong>, tal com defineix la llei, a m\u00e9s d\u2019altres formes d\u2019assetjament laboral, com el <strong>psicol\u00f2gic o el mobbing<\/strong>.<\/p>\n<h2><strong>Continguts essencials d\u2019un protocol efica\u00e7<\/strong><\/h2>\n<ul>\n<li><strong>Declaraci\u00f3 de principis<\/strong> de respecte i toler\u00e0ncia zero.<\/li>\n<li><strong>Canal de den\u00fancia confidencial<\/strong> accessible per a tothom.<\/li>\n<li><strong>Procediment clar<\/strong> amb investigaci\u00f3 imparcial i terminis establerts.<\/li>\n<li><strong>Protecci\u00f3 de les parts implicades<\/strong>, garantint confidencialitat.<\/li>\n<li><strong>Formaci\u00f3 i sensibilitzaci\u00f3<\/strong> de tota la plantilla i l\u2019alta direcci\u00f3.<\/li>\n<\/ul>\n<h2><strong>Protecci\u00f3 de dades i confidencialitat<\/strong><\/h2>\n<p>Els casos d\u2019assetjament impliquen dades sensibles. Segons l\u2019AEPD:<\/p>\n<ul>\n<li>Utilitzar <strong>codis identificatius<\/strong> per preservar identitats.<\/li>\n<li>Sol\u00b7licitar nom\u00e9s les dades estrictament necess\u00e0ries.<\/li>\n<li>No utilitzar les dades fora del proc\u00e9s i limitar-ne la difusi\u00f3.<\/li>\n<\/ul>\n<p>A m\u00e9s, el protocol ha d\u2019informar sobre el tractament de dades i els drets de les persones afectades, d\u2019acord amb RGPD i LOPDGDD. El consentiment \u00e9s necessari per cedir dades, tret de requisit legal.<\/p>\n<h2><strong>Riscos i sancions<\/strong><\/h2>\n<p>Les conseq\u00fc\u00e8ncies s\u00f3n molt greus si no hi ha protocol:<\/p>\n<ul>\n<li><strong>Multes administratives<\/strong> de <strong>7.501 \u20ac (lleu)<\/strong> fins a <strong>225.018 \u20ac (molt greu)<\/strong>.<\/li>\n<li>El nou <strong>Reial Decret 1026\/2024<\/strong> obliga les empreses amb m\u00e9s de 50 empleats a implantar protocols contra l\u2019assetjament i viol\u00e8ncia, incloent-hi tamb\u00e9 personal extern.
