Aquesta \u00e9s una pregunta que es fan molts treballadors, sobretot en un moment com l\u2019actual, en el qual molts sistemes de control, fitxatge i seguretat capten imatges, empremtes o la ubicaci\u00f3 en temps real.<\/p><\/blockquote>\n<p>Per aix\u00f2 avui volem parlar-vos de <strong>com poden tractar les vostres dades personals en l\u2019\u00e0mbit laboral<\/strong>, quins <strong>drets teniu respecte a aquestes dades<\/strong> i resoldre algunes <strong>preguntes freq\u00fcents<\/strong> gr\u00e0cies a la informaci\u00f3 recopilada de l\u2019<strong>Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades<\/strong>.<\/p>\n<p>Abans que res, volem aclarir qu\u00e8 \u00e9s una dada personal, ja que el mateix RGPD, en el seu art. 4.1 del RGPD, considera com a tal <strong>\u201ctota informaci\u00f3 relativa a una persona f\u00edsica identificada o identificable\u201d<\/strong>, per exemple: el nom i cognoms, la data de naixement, domicili, vida acad\u00e8mica o laboral, informaci\u00f3 fotogr\u00e0fica, la veu, n\u00famero d\u2019identificaci\u00f3, entre molts altres.<\/p>\n<p>Aix\u00ed mateix, les dades poden classificar-se en gen\u00e8riques (les anteriorment descrites) i els catalogats com <strong>especialment sensibles<\/strong>, com l\u2019origen \u00e8tnic o racial, les opinions pol\u00edtiques, les creences religioses, l\u2019afiliaci\u00f3 sindical, les dades gen\u00e8tiques, les dades biom\u00e8triques i les dades de salut, vida o orientaci\u00f3 sexuals.<\/p>\n<p>L\u2019art. 9.1 del RGPD considera que <strong>el tractament d\u2019aquesta \u00faltima categoria de dades est\u00e0, en principi, prohibida<\/strong>, encara que es permet quan \u00e9s necessari per al compliment d\u2019obligacions i l\u2019exercici de drets del responsable del tractament o de l\u2019interessat.<\/p>\n<p>Una de les preocupacions actuals dels treballadors \u00e9s el sistema de fixatge. Per aix\u00f2 volem resoldre alguns dubtes com&#8230;<\/p>\n<h2><strong>Quins sistemes de control horari poden utilitzar les empreses?<\/strong><\/h2>\n<p>Una empresa podr\u00e0 implantar el sistema que cregui que \u00e9s m\u00e9s adequat per la seva activitat, tant <strong>manual, anal\u00f2gic o digital<\/strong>, per generar un registre diari de la jornada de cada treballador.<\/p>\n<p>Aquest registre deu estar a disposici\u00f3 del treballador, de la Inspecci\u00f3 de Treball i dels Representants Legals dels Treballadors, i haur\u00e0 de ser emmagatzemat durant 4 anys.<\/p>\n<h2><strong>\u00c9s necessari el consentiment del treballador per implantar aquests sistemes?<\/strong><\/h2>\n<p><strong>No ser\u00e0 obligatori per part dels treballadors<\/strong> per implantar aquests sistemes de fitxatge, ja que la mateixa norma laboral en <strong>l\u2019art. 34.9 ET obliga a l\u2019empresa a registrar la jornada de cada persona treballadora<\/strong> pel compliment d\u2019una obligaci\u00f3 legal aplicable al responsable del tractament.<\/p>\n<p>Per\u00f2 aix\u00f2 no exclou que l\u2019empresa hagi d\u2019informar els seus treballadors de l\u2019exist\u00e8ncia del registre i de la finalitat del tractament de les dades personals.<\/p>\n<h2><strong>Vulnera la normativa de protecci\u00f3 de dades el sistema de fitxatge per empremta digital?<\/strong><\/h2>\n<p>Segons l\u2019<strong>Audi\u00e8ncia Nacional aquest sistema \u00e9s totalment v\u00e0lid <\/strong>i no requereix consentiment per part dels treballadors per la seva implantaci\u00f3, m\u00e9s enll\u00e0 del dret a la informaci\u00f3.<\/p>\n<p>Aquest sistema no incorporar\u00e0 la dada de l\u2019empremta digital, sin\u00f3 que el lector generar\u00e0 un identificador num\u00e8ric de l\u2019empremta que es correspondr\u00e0 amb la targeta del treballador.<\/p>\n<h2><strong>I \u00e9s legal que les targetes d\u2019identificaci\u00f3 tinguin el nom, cognoms i DNI?<\/strong><\/h2>\n<p>Quan un treballador ha de portar una targeta identificativa amb les seves dades personals sempre s\u2019ha de <strong>justificar que la finalitat \u00e9s garantir la seva identificabilitat en l\u2019exercici de les seves funcions<\/strong>, com disposa l\u2019art. 6 del RGPD, si no podria no ser emparat per la normativa de protecci\u00f3 de dades.<\/p>\n<p>Una altra preocupaci\u00f3 que tenen els treballadors \u00e9s sobre l\u2019acc\u00e9s a la seva ubicaci\u00f3 en temps real com a forma de control durant l\u2019horari laboral.<\/p>\n<h2><strong>Es pot instal\u00b7lar un GPS en els cotxes d\u2019empresa per controlar als treballadors?<\/strong><\/h2>\n<p>Segons l\u2019art. 20.3 de l\u2019Estatut dels Treballadors, <strong>l\u2019empresari pot emprar les mesures que cregui convenients per vigilar, controlar i verificar el compliment de les obligacions i deures laborals que t\u00e9 el treballador<\/strong>.<\/p>\n<p>Encara que no sigui obligatori el consentiment dels treballadors, l\u2019empresari haur\u00e0 de complir el dret d\u2019informaci\u00f3 de l\u2019art. 13 del RGPD, explicant de forma clara l\u2019exist\u00e8ncia d\u2019aquests dispositius.<\/p>\n<h2><strong>Per acabar, podr\u00e0 l\u2019empresari sol\u00b7licitar el n\u00famero de m\u00f2bil o correu electr\u00f2nic personal del treballador?<\/strong><\/h2>\n<p><strong>Cap norma exigeix que el treballador hagi de facilitar aquestes dades a l\u2019empresari per exercir el seu treball. <\/strong>Per tant, aquesta mesura s\u2019excedeix del que est\u00e0 perm\u00e8s en la normativa de protecci\u00f3 de dades.<\/p>\n<p>No obstant aix\u00f2, podria haver-hi excepcions si la prestaci\u00f3 de serveis per l\u2019empresa inclou una disponibilitat personal del treballador fora del centre de treball o de la jornada laboral.
